Anybody have any thoughts to share on the Gonzales v Oregon decision? I ask because whether I agree with it or not, I always seem to learn something from the analysis that several of you throw out on a decision such as this.
From my perspective, it seems that this is one of those cases where both sides of the argument are reversing course from their ideology in order to argue the matter. The conservative justices who normally trumpet state's rights are saying that the CSA and the federal government's exercise of that law takes precedent over a democratically decided state law. For myself personally, I'm havinga hard time deciding where I stand on this one. I don't think the door can be opened to states enacting laws which are in direct conflict with exsisting federal laws. But on the ohter hand, I think that the way that Oregon handled the assisted suicide issue is EXACTLY how such issues should be handled - letting the people decide.
